I represent a non-profit organization, Empowering Change, registered as a 501(c)3 and with the California Dept of State. BMO Bank made a representation that a business checking account would be opened for the organization in January 2025, which I, as board member, took on good faith. However, after opening the account and depositing a $10,000 personal donation BMO reneged on its stated promise and decided to summarily close the account. AS such, the funds donated could not be used for their stated charitable cause and, per IRS and GAAP were due to be refunded to the donor, Bradley Gudzinas.However, BMO claimed that their "policy" was otherwise and only refunded $2,000 of the $10,000 donation by claiming that the balance was due to Empowering Change the organization; although due to the material misrepresentation and possible deceptive business practices and fraud of BMO was left without any financial account to recover the funds. Therefore, they are in limbo and BMO has resolutely lied and resisted good-faith efforts to have the funds returned.
The amount of $8,000 is due to me Bradley Gudzinas. I have explicitly communicated this to BMO as both the donor and board president of Empowering Change and they have refused, citing unspecified "policy" that the record will show they did not follow accordingly.
